Idaho Residential Lease Agreement Form
An Idaho Residential Lease Agreement Form is a written contract that is used when a real estate owner or realtor wishes to rent out their entire property or a room to an individual (a tenant) for a monthly fee.
This should be used after a landlord reviews an applicant's rental application to determine if they will be a trustworthy tenant.
By using this agreement you and the other party will have a clear understanding of the terms and conditions as well as the obligations and responsibilities that you must comply with.
For example, a landlord must guarantee that the residence is safe and in good condition. A tenant must agree to pay rent on time and that the residence will be kept clean and in the same conditions as when the lease begins.
The form should also mention key topics such as:
- Tenant’s and landlord’s personal information
- Lease term
- Disclosures
- Terms and conditions
- Obligations
Each state has its own laws and regulations that determine what a Residential Lease Agreement must include. In Idaho, standard Lease Agreements must follow the legal requirements set out in the state legislature.
Required Disclosures
Each state will require certain information to be disclosed to the tenant. In Idaho, a landlord must disclose the following:
- Lead-Based Paint Disclosure: All rental properties constructed before 1978 must include a brochure that communicates the potential hazards of lead-based paint within the walls attached to the Residential Lease Agreement. This is a federal law.
Rent Grace Period
No law exists that regulates a grace period in Idaho. The rent must be paid on time as determined by the agreement.
A notice to quit can be given to a tenant that fails to pay the rent by the landlord.
Security Deposits
A landlord in Idaho may charge any amount as desired, as no law states a maximum amount for security deposits.
After the lease ends, the deposit must be returned to the tenant after 21 days for verbal agreements or 30 days after the term end date mentioned in the agreement (§ 6-321).
